Benzene Plaintiffs Urge Court Not to Reconsider Order Denying Motion to Dismiss, Say No Changes in Law or Circumstance Exist

PHILADELPHIA –– Benzene plaintiffs have opposed U.S. Steel’s motion to reconsider a court order denying their dismissal attempts, contending that the dismissal of the company’s co-defendants does not constitute a “substantial change in the circumstances.”

In the May 30 opposition brief filed in the Pennsylvania Court of Common Pleas for Philadelphia County, the plaintiffs additionally noted that U.S. Steel had the opportunity to oppose the summary judgment motions filed by its co-defendants but failed to do so.
