Pa. Appellate Court Converts Opinion Precluding Expert Testimony in Pesticide Exposure Case to Published




PHILADEPHIA –– A Pennsylvania appellate court has granted a plaintiff motion to convert an opinion reversing a decision excluding plaintiff expert testimony to published, according to a recent order.

In the two-page June 6 order, the Pennsylvania Superior Court converted its May 22 memorandum opinion to a published opinion, in which it found that the trial court’s Frye analysis was “overly expansive.”

In its earlier opinion, the appellate court determined that literature in studies support the general acceptance of the principle that long-term exposure to pesticides can cause or increase the risk of developing leukemia.
