PHOENIX — An Arizona federal judge has denied C.R. Bard’s motion for judgment as a matter of law in the wake of an adverse $3.6 million award in an IVC filter case, ruling the evidence supported the jury’s finding that the manufacturer negligently failed to adequately warn the plaintiff’s doctor of the device’s risks.

In the June 19 order, Judge David Campbell also denied Bard’s bid for a new trial, ruling that the verdict, in which the jury found Bard is not liable for strict liability failure-to-warn, was not inconsistent. The judge said the jury's findings can be harmonized because …
