S&N Seeks to Limit Scope of Discovery as to Preempted BHR Hip Claims

BALTIMORE — Smith & Nephew Inc. is urging a Maryland federal judge to limit the scope and conduct of discovery in the BHR Hip multidistrict litigation, arguing that plaintiffs cannot seek information relating to claims that the judge has already dismissed as preempted.

In its June 6 reply brief filed in the U.S. District Court for the District of Maryland, S&N asserts that it is seeking to limit the scope of discovery “in a manner consistent” with the MDL court’s March 26 order.
