Pa. Appellate Court Reverses Order Precluding Expert Testimony in Pesticide Exposure Case

PHILADELPHIA –– A Pennsylvania appellate court has reversed an order excluding plaintiff expert testimony in a pesticide exposure suit, finding that the trial court’s Frye analysis was “overly expansive.”

In the May 22 opinion, the Pennsylvania Superior Court found that literature in studies support the general acceptance of the principle that long-term exposure to pesticides can cause or increase the risk of developing leukemia.

The plaintiffs brought the claims on behalf of Thomas J. Walsh, contending that his work as a groundskeeper and golf course superintendent required him to apply insecticides and fungicides to the gold course. As a result …
