Smith & Nephew Opposes Proposed Amended Complaint in BHR Hip Component Case

BALTIMORE — Smith & Nephew Inc. has opposed a couple’s request to amend their complaint involving a BHR hip implant component to add Smith & Nephew plc as a defendant, arguing the holding company is not involved in the manufacture and marketing of the component.

In a May 21 response filed in the U.S. District Court for the District of Maryland, Smith & Nephew Inc. further argues that plaintiffs’ proposed amendments are futile because they seek to assert claims that had already been dismissed by the multidistrict litigation court.
