Trial Begins in 2nd Bellwether Bard IVC Filter Case




PHOENIX — Trial has begun in the second bellwether Bard IVC filter case on May 15, in which the jury will hear plaintiff Doris Jones’ claims that C.R. Bard Inc. failed to adequately warn physicians about the known defects and higher complication rates associated with its Eclipse IVC filter.

Judge David G. Campbell of the U.S. District Court for the District of Arizona said the trial will last three weeks. Noting that the plaintiffs have the burden of proof, the judge has allocated 28 hours to plaintiffs and 27 hours to defendants.
