OMAHA, Neb. – A Nebraska federal magistrate judge has refused to compel Top’s Personnel Inc. to produce discovery relating to a purported class action accusing Applied Underwriters Inc. of charging policyholders grossly inflated workers’ compensation premiums.

On May 4, Magistrate Judge Cheryl R. Zwart of the U.S. District Court for the District of Nebraska found AUI did not comply with the court’s scheduling order, which provides that motions to compel cannot be filed without first contacting the court to set a conference for discussing the dispute.
