Plaintiff May Amend IVC Filter Claims Against BSC, Ohio Federal Judge Says

COLUMBUS, Ohio — An Ohio federal judge has allowed a plaintiff to amend her complaint in a Boston Scientific Corp. IVC filter action to properly allege claims under the Ohio Products Liability Act, ruling that such amendment would not be futile, nor would it prejudice the defendant.

In a May 4 order, Chief Judge Edmund Sargus Jr. of the U.S. District Court for the Southern District of Ohio denied BSC’s motion to dismiss the action, ruling there is nothing to indicate that the plaintiff cannot properly plead her claims.
