Ky. Federal Judge Remands Multi-Plaintiff Essure Birth Control Case

PIKEVILLE, Ky. — A Kentucky federal judge has remanded a multi-plaintiff Essure birth control lawsuit to state court, ruling that the case does not does not raise a substantial issue of federal law.

In an April 23 order, Chief Judge Karen Caldwell of the U.S. District Court for the Eastern District of Kentucky further ruled that the plaintiffs have asserted colorable claims against the non-diverse medical provider defendant and thus it was not fraudulently joined.
