Utica Seeks Reconsideration of Summary Judgment Denial in $3.2 Million Reinsurance Case

SYRACUSE, N.Y. — Utica Mutual Insurance Co. has asked a New York federal judge to reconsider his refusal to award it summary judgment in a dispute over whether Munich Reinsurance America Inc. is obligated to pay Utica’s defense expenses arising from an underlying asbestos claims settlement.

In a motion for reconsideration filed in the U.S. District Court for the Northern District of New York, Utica says Judge Brenda K. Sannes ignored extrinsic evidence proving that Munich is obligated under its reinsurance certificates to pay the defense expenses.
