Ariz. Federal Jury Awards Plaintiff $4 Million in 1st Bard IVC Filter Bellwether Case

PHOENIX – An Arizona federal jury has awarded a plaintiff $2 million in compensatory damages and $2 million in punitive damages in the first bellwether C.R. Bard IVC filter lawsuit to go to trial, finding the company is 80 percent liable and therefore must pay $3.6 million.
The trial, which was presided over by Judge David G. Campbell of the U.S. District Court for the District of Arizona, began on March 13. The judge limited plaintiff Sherr-Una Booker's claims to defective design, failure to warn, and punitive damages.
