Ariz. Federal Jury Begins Deliberations in 1st Bard IVC Filter Bellwether Action

PHOENIX – An Arizona federal jury has begun deliberations in the first bellwether IVC filter lawsuit, in which C.R. Bard is accused of negligently designing its IVC filters and failing to warn doctors and the public of the devices' risks, including perforation of the inferior vena cava and migration.

The trial, which is being presided over by Judge David G. Campbell of the U.S. District Court for the District of Arizona, began on March 13. The judge limited plaintiff Sherr-Una Booker's claims to defective design, failure to warn, and punitive damages.
