N.J. Appellate Court Upholds Summary Judgment Award to Bard, Davol in Hernia Mesh Case

CAMDEN, N.J. — A New Jersey appellate court has upheld an award of summary judgment to the makers of a polypropylene hernia repair mesh device, agreeing with the trial court that the plaintiff failed to present expert testimony that the device was defective and caused his injuries.

In a March 19 opinion, the New Jersey Superior Court, Appellate Division, further affirmed that the plaintiff’s negligence claim fails because his experts did not opine as to the standard of care owed by defendants and, thus, whether they breached it.
