Abbott Moves to Quash Subpoena of AbbVie CEO Richard Gonzalez in Depakote Action

MIAMI — Abbott Laboratories Inc. has moved to quash subpoenas for the academic, personnel and financial donation records of AbbVie CEO Richard Gonzalez in a Depakote birth defect case, arguing Gonzalez was not involved in the labeling or marketing of the anti-seizure drug.
In a March 9 motion filed in the U.S. District Court for the Southern District of Florida, Abbott and Gonzalez contend that Gonzalez had no involvement whatsoever with Depakote at any time relevant to the action, and that the documents sought include private and confidential information and have no relationship to plaintiffs’ failure-to warn-claims.
