Mo. Federal Court Stays Recently Removed Talcum Powder Actions, Says MDL Court Should Decide Remand Motion

ST. LOUIS –– A Missouri federal court has granted Johnson & Johnson’s motions to stay two separate multi-plaintiff talcum powder cases, opining that the plaintiffs will have a “full and fair” opportunity to present their arguments for remand to the national MDL Court.

In orders issued March 7, the U.S. District Court for the Eastern District of Missouri stayed all proceedings in the matters pending transfer to the MDL Court, rejecting the plaintiffs’ position that the removals were “pure gamesmanship” used to “deprive them of their day in court.”
