Ga. Court of Appeals Affirms Board Decision Denying Benefits, Says Board Doesn’t Have Jurisdiction over Asbestos Claims

ATLANTA –– The Georgia Court of Appeals has affirmed the finding of the state’s Workers’ Compensation Board that it did not have jurisdiction over underlying asbestos-related exposure that occurred in Alabama, saying that the “accident” that resulted in his injury occurred while he was employed in the neighboring state.

In the Feb. 27 opinion, the appellate court reasoned that the state’s Act applies only where both the employer and employee are subject to the Act.
