DePuy Seeks Appellate Review of District Court's Refusal to Dismiss Pinnacle FCA Claims

BOSTON - DePuy Orthopaedics Inc. has asked a federal appellate court to review a district court's refusal to dismiss claims that they violated the False Claims Act by causing doctors to seek government reimbursement for latently defective versions of the Pinnacle hip replacement device.

DePuy and its parent company Johnson & Johnson filed a petition for certiorari on Feb. 7 in the 1st Circuit U.S. Court of Appeals. They seek to challenge a Jan. 17 order by the U.S. District Court for the District of Massachusetts denying the manufacturers' motion without prejudice.
