Mipro US Awarded Summary Judgment in M-Cor Hip Action on Successor Liability Issue

SPOKANE, Wash. - A Washington federal judge has awarded summary judgment to Mipro US in an M-Cor System hip replacement action, ruling that it is not liable as a successor to the original manufacturer for claims arising from alleged defects in the devices.

On Feb. 7, Judge Rosanna M. Peterson of the U.S. District Court for the Eastern District of Washington found the plaintiffs failed to produce evidence supporting the application of the product line exception to the state's general rule of successor corporation non-liability.
