Ind. Federal Judge Strikes Medtronic's Preemption-Related Exhibits in MiniMed Insulin Pump Case

INDIANAPOLIS - An Indiana federal judge has stricken exhibits Medtronic filed in support of its motion to dismiss a MiniMed insulin pump action, ruling that the documents are immaterial at the present time because they are related only to the manufacturer's preemption argument, which cannot be decided at the pleading stage.

However, in a Feb. 8 order, Chief Judge Jane Magnus-Stinson of the U.S. District Court for the Southern District of Indiana said she will take judicial notice of the documents in the future.
