LOS ANGELES - A California federal judge has dismissed a putative class action accusing Actos makers of hiding the drug's risks, ruling that because the plaintiffs previously released their claims in a global settlement, there is no live "case or controversy."

On Jan. 25, Chief Judge Virginia Phillips of the U.S. District Court for the Central District of California further held that the filing of an amended complaint with a substituted plaintiff does not cure the jurisdictional defect because the class was never certified.
