CHICAGO –– An Illinois federal court has denied a plaintiff’s motion for summary judgment in a soil and groundwater contamination suit, saying that the plaintiff has failed to prove that the benzene and vinyl chloride levels triggered any obligations under Indiana law.

In a Jan. 29 opinion, the U.S. District Court for the Northern District of Illinois further opined that the plaintiff had not shown that no genuine issue of material fact existed as to whether a Stock Purchase Agreement (SPA) entitled the defendant to indemnification for its environmental cleanup costs.
