PHILADELPHIA –– Benzene plaintiffs whose claims were dismissed on forum grounds have asked the court to reconsider its decision, maintaining that they would be prejudiced if the case has to be re-filed in an alternative forum given the injured plaintiff’s severe health.

In a Jan. 19 motion to reconsider filed in the Pennsylvania Court of Common Pleas for Philadelphia County, the plaintiffs also pointed to the “long list” of witnesses and evidence available in Philadelphia County and argued that the state is a “legitimate basis of convenience.”
