La. Remands Asbestos Case, Says Removing Defendant Failed to Prove Government Control

NEW ORLEANS –– A Louisiana federal court has remanded an asbestos action, finding that the removing defendant had failed to prove that the government had control over safety procedures or the use of asbestos.
In the Jan. 19 opinion, the U.S. District Court for the Eastern District of Louisiana further found that the removing defendant had failed to prove that the U.S. Navy restricted their ability to warn their employees of the presence of asbestos.
