J&J Defendants Seek Dismissal of Talc Claim Again, Say Amended Complaint Didn’t Cure Deficiencies

FORT LAUDERDALE, Fla. –– Johnson & Johnson defendants have again filed a motion to dismiss a fraud claim asserted in a Florida state court talcum powder complaint, saying that an amended complaint –– filed by the plaintiffs in an effort to overcome deficiencies acknowledged by the court –– still fails to state a claim upon which relief can be granted.

In a Dec. 14 motion filed in the Florida 17th Judicial Circuit for Broward County, the Johnson & Johnson defendants accuse the plaintiffs of filing an amended pleading with only “vague allegations” that the defendants edited scientific reports.
