La. Court Grants Defense Motion for Partial Summary Judgment in Asbestos, Silica Case, Says Claim is Prescribed

NEW ORLEANS –– A Louisiana federal court has granted a defense motion for partial summary judgment in an asbestos and silica exposure suit, finding that the plaintiff had inherited “a meaningless time-barred claim for medical expenses.”

In the Jan. 2 order, the U.S. District Court for the Eastern District of Louisiana found that the plaintiff had failed to offer any relevant case law to persuade the court that a prescribed claim can be resurrected y the prescribed party’s death and brought by his surviving widow.
