Third-Party Complaint in Silica Coverage Case Dismissed for Lack of Personal Jurisdiction

EL DORADO, Ark. — An Arkansas federal judge has dismissed for lack of personal jurisdiction a third-party complaint against the alleged successors-in-interest to Pulmosan Safety Equipment Corp., finding the defendants lacked the “continuous and systematic” contacts with Arkansas to make them essentially “at home” in the state.

In a Dec. 19 order, Judge Susan O. Hickey of the U.S. District Court for the Western District of Arkansas further found the plaintiffs failed to show their alleged injuries arose from activities that the third-party defendants purposefully directed at Arkansas defendants.
