NEW YORK –– A New York appellate court has granted Chevron Corp.’s motion for leave to appeal a decision affirming a trial court’s order denying the defendant summary judgment.

In a Dec. 14 order, the New York Appellate Division for the First Department denied the defendant’s request for re-argument, however.

Its two-page order, the Appellate Division specifically certified the question of whether the “order of this Court, which affirmed the order of the Supreme Court, properly made?”
