N.Y. Federal Court Dismisses Talcum Powder Case, Cites Plaintiff’s Failure to File Complaint, Serve Defendants

BUFFALO, N.Y. –– A New York federal court has dismissed a talcum powder lawsuit for failure to comply with an order to show cause, according to a recent order.

In the Dec. 1 order, the U.S. District Court for the Western District of New York explained that the plaintiffs had failed to file a complaint and serve it on any of the defendants within 90 days of removal.

Gerald M. Kalisz originally filed a complaint in New York Supreme Court for Erie County in June, contending that Sharon A. Kalisz was injured as a result of using talcum powder products.
