Calif. Federal Judge Awards Mentor Summary Judgment in Saline Breast Implant Lawsuit

LOS ANGELES — A California judge has dismissed a woman’s lawsuit alleging defective Mentor breast implants caused her to develop biotoxin disease, ruling her expert’s opinions are unreliable because they did not rule out the plaintiff’s exposure to environmental mold.

On Nov. 8, Judge Otis D. Wright II of the U.S. District Court for the Central District of California further ruled that the plaintiff’s manufacturing defect and negligence claims are preempted because the plaintiff did not identify specific requirements in the Current Good Manufacturing Practices that were violated by Mentor.
