Lawsuit Involving Allegedly Defective Arthrex Internal-Fixation Plate to Proceed in Nevada

RENO, Nev. — A Nevada federal judge has allowed a lawsuit alleging injuries caused by an allegedly defective internal-fixation plate manufactured by Arthrex Inc. to proceed, finding the plaintiffs adequately pled their claims of strict product liability and breach of implied warranty.

In an Oct. 11 order, Judge Larry Hicks of the U.S. District Court for the District of Nevada dismissed the plaintiffs’ claim for breach of express warranty as inadequately pled, but allowed them to amend their complaint to cure the deficiencies.
