Lawsuit Involving Medtronic Spinal Rods, Screws Inadequately Pled, Ill. Federal Judge Says

CHICAGO — An Illinois federal judge has dismissed with prejudice a lawsuit alleging injuries caused by allegedly defective Medtronic spinal rods and screws, ruling that the claims of negligence, failure to warn, and breach of warranties were inadequately pled.

In an Oct. 5 order, Judge Manish Shah of the U.S. District Court for the Northern District of Illinois said the plaintiff failed to factually support his claim that defects in the device caused his injuries. The judge further found the failure-to-warn claim is barred by the learned intermediary doctrine.
