Fla. Judge Tosses Cradle Cap Treatment Action for Lack of Evidentiary Support

FORT MYERS, Fla. — A Florida federal judge has dismissed a lawsuit against the maker of a cradle cap treatment, ruling the plaintiff did not provide evidentiary support for her claims of defective manufacture/design and failure to warn.

In a Sept. 28 order, Judge John E. Steele of the U.S. District Court for the Middle District of Florida noted the plaintiff failed to present expert testimony to back her claims that there was a proximate causal connection between the product and her daughters’ alleged injuries.
