Plaintiffs Barred from Adding Surgeon as Defendant in Wright Foot Wedge Action

SEATTLE — A Washington federal judge has denied plaintiffs’ request to assert a medical malpractice claim against their surgeon in a lawsuit involving Wright Medical’s Wedge foot implant, finding they failed to show good cause for overriding the court’s scheduling order.

On Sept. 19, Judge James Robart of the U.S. District Court for the Western District of Washington further held that such an amendment would be futile because the proposed claim is barred by the state’s statute of limitations for medical malpractice claims.
