Transvaginal Mesh Claims Time-Barred, 10th Cir. Affirms

DENVER — A federal appeals court has upheld dismissal of a transvaginal mesh action, finding the claims are time-barred because the plaintiff was aware of the cause of her injuries by November 2007, but did not sue American Medical System Inc. and Caldera Medical Inc. until 2014.

In an Aug. 25 opinion, the 10th Circuit U.S. Court of Appeals explained that the plaintiff knew by November 2007 that the Desara Sling had migrated and was causing her severe pain and other complications.
