La. Court Remands Asbestos Action, Finds No Evidence that Government Prevented Defendant from Taking Precautionary Measures

NEW ORLEANS –– A Louisiana federal court has remanded an asbestos action after finding that the removing defendant had failed to show that there was a causal nexus between its actions under color of federal office and the plaintiff’s claims.

The defendants filed a notice of appeal on Aug. 17, indicating its intent to appeal the U.S. District Court for the Eastern District of Louisiana’s remand order to the 5th Circuit U.S. Court of Appeals.
