Del. Court Denies CertainTeed’s Motion for Summary Judgment in Asbestos Case

WILMINGTON, Del. –– A Delaware state court has denied CertainTeed’s motion for summary judgment in an asbestos case, finding that the plaintiff had presented sufficient evidence to overcome the defendant’s challenges.

In the Aug. 17 order, the Delaware Superior Court wrote that the issues of fact raised by CertainTeed were more appropriate for a jury to weigh.

Plaintiffs Jack E. and Sandra Trousdale filed the underlying complaint, contending that Jack Trousdale was harmed when he was exposed to asbestos-containing products manufactured by a number of companies, including CertainTeed Corp.
