JPML Refuses to Vacate Transfer Orders in 25 Talcum Powder Cases; Reiterates Position on Pending Remand Motions

WASHINGTON, D.C. –– The JPML has denied efforts by plaintiffs in 17 talcum powder cases to vacate transfer orders moving their lawsuits to the national coordinated multidistrict litigation docket, rejecting the plaintiffs’ stance that their cases differ from those in the MDL because they include pharmacies as defendants.

In an Aug. 3 order, the U.S. Judicial Panel on Multidistrict Litigation also rejected motions to vacate transfer orders issued in eight other actions in which plaintiffs argued that subject matter jurisdiction is lacking, reiterating that “jurisdictional issues do not present an impediment to transfer.”
