Del. Court Awards Summary Judgment to Cleaver-Brooks in Asbestos Case

WILMINGTON, Del. –– A Delaware court has awarded summary judgment to Cleaver-Brooks Inc. in an asbestos case, concluding that the expert report proffered on behalf of the plaintiff creates nothing more than a “speculative nexus” between the alleged injuries and the defendant’s product.

In the July 19 opinion, the Delaware Superior Court explained that while the decedent presented evidence that he worked with Cleaver-Brooks products, a subsequent expert report “is a generic causation report that does not link Plaintiff’s disease to a particular product.”
