Talcum Powder MDL Court Administratively Dismisses Motions to Dismiss, Remand in Wake of BMS Ruling

TRENTON, N.J. –– The federal court overseeing the national coordinated docket for talcum powder claims has issued a sua sponte order administratively dismissing motions to dismiss claims based on lack of personal jurisdiction and separate motions to remand, citing the U.S. Supreme Court’s recent decision in Bristol-Myers Squibb Co. v. Superior Court of California.

In the order issued July 13, the U.S. District Court for the District of New Jersey noted that the high court’s decision “substantially impacts, if not resolves, the issues raised by these competing motions.”
