Ill. Appellate Court Reverses Order on Forum, Says It Would Be ‘Manifestly Unfair’ to Try Asbestos Case in Cook County

CHICAGO – An Illinois appellate court has reversed the denial of a motion to transfer in an asbestos case, saying that the decedent’s deposition testimony that he was “not sure” if he was exposed to asbestos in the county in which the lawsuit was filed was not enough to find a connection between the litigation and the county.

In the June 15 order, the Illinois First Judicial District Court of Appeal opined that the “relevant factors overwhelmingly” favored transfer to Winnebago County.
