Pa. Federal Judge Denies Bid to Amend Complaint a 3rd Time in Mortgage Reinsurance Case

PITTSBURGH, Pa. — A Pennsylvania federal judge has denied plaintiffs’ motion to amend their complaint a third time in a mortgage reinsurance kickback action, rejecting their theory that the one-year statute of limitations for violations of the Real Estate Settlement Practices Act renews with each mortgage reinsurance payment.

In the June 6 order, Judge Mark R. Hornak noted that the 3rd Circuit U.S. Court of Appeals has recently reaffirmed that RESPA’s statute of limitations "runs from the date of the occurrence of the violation, which begins at the closing of the loan."
