Benzene Defendants Oppose Plaintiffs’ Second Motion to Remand, Say Efforts Are ‘Disguised Attempt’ for Reconsideration of Prior Order

PHILADELPHIA –– Benzene defendants Sunoco Inc. and CRC Industries Inc. have opposed a motion to remand, saying the plaintiffs’ second attempt to have the case proceed in state court should be rejected since the court has already weighed in on the matter.

In a May 3 opposition brief filed in the U.S. District Court for the Eastern District of Pennsylvania, the defendants argued that the motion to remand “is a disguised attempt to request this Court to reconsider its … order denying the first motion to remand.”
