Talc Defendants File Emergency Motion Asking 8th Circuit to Enjoin Plaintiffs From Pursuing Claims in State Court

ST. LOUIS –– Defendants involved in a talcum powder appeal have filed an emergency motion to enjoin a plaintiff from trying his claims in state court, saying that allowing the claims to be tried as part of a multi-plaintiff trial would deprive the court the opportunity to correct the District Court’s allowance of “blatant forum shopping.”

In the May 12 motion filed in the 8th Circuit U.S. Court of Appeals, the defendants said that allowing the trial to proceed would “moot this appeal and effectively accomplish the very forum shopping and attack on removal jurisdiction that the district court should …
