Louisiana Federal Court Grants Voluntary Motion to Dismiss Accolade Case with Prejudice; Plaintiff Says ‘All Claims Settled’

LAKE CHARLES, La. –– A Louisiana federal court has entered an order dismissing with prejudice all claims asserted against Stryker Howmedica Osteonics Corp. in an Accolade hip stem action.

In an April 26 order, the U.S. District Court for the Western District of Louisiana dismissed the claims just one day after the plaintiffs indicated that “all claims and demands have been settled and compromised….”

The settlement agreement comes four months after a stay was lifted in the case and an October 2017 trial date was scheduled; the stay was implemented while the plaintiff underwent revision surgery.
