Ky. Court Tosses Chemical Exposure Claims Against Gates Rubber as Time-Barred

LOUISVILLE, Ky. –– A Kentucky federal court has awarded summary judgment to Gates Rubber Co. in a chemical exposure case, concluding that the claims were filed more than two years after the statute of limitations had expired.

In the May 2 opinion, the U.S. District Court for the Western District of Kentucky noted that the plaintiff had not opposed the defendant’s motion for summary judgment.

Plaintiff Dale Milby filed the complaint, contending that his employment with Gates Rubber Co. from 1975 to 1999 exposed him to toxic chemicals. Milby specifically said that he was not provided with adequate protective gear. …
