N.J. Appellate Court Reverses $25 Million Accutane Verdict, Remands Action

NEWARK, N.J. — A New Jersey appellate court has reversed a $25 million Accutane verdict and remanded the case, ruling that the trial court erred in barring Hoffman-La Roche from presenting the testimony of two expert witnesses as to the merits of published epidemiological studies.

On May 2, the New Jersey Superior Court, Appellate Division, further held that remand is warranted because the plaintiff’s prescribing doctor was never asked whether her decision to prescribe Accutane would have been different had the drug come with a stronger warning.
