Ga. Federal Judge Refuses to Dismiss Canal Insurance’s Claims Against Non-Resident Defendants

ATLANTA — A federal judge has refused to dismiss Canal Insurance Co.’s claims against four individual non-resident defendants who allegedly received cash transfers from Golden Isles Reinsurance Company Ltd., finding the defendants purposely availed themselves of their connections to Georgia.

On April 13, Judge Leigh Martin May of the U.S. District Court for the Northern District of Georgia determined that Georgia’s long-arm statute applies because the defendants each accepted and deposited a cash transfer that originated in Georgia, from a presumed investment they formed with a Georgia resident, in a company registered to do business in Georgia.
