Kentucky Federal Court Awards Summary Judgment to Defendants in Benzene Suit, Says Claims are Time-Barred

LOUISVILLE, Ky. –– A Kentucky court has awarded summary judgment to Gates Rubber Co. in another chemical exposure suit, ruling that the plaintiff had failed the underlying action more than two years after the limitations period has expired.

In its latest order awarding summary judgment to the defendant –– entered April 6 –– the U.S. District Court for the Western District of Kentucky addressed the pending motion despite the fact that the plaintiff had failed to respond to it.
