DALLAS — A Texas federal judge has remanded a hail damage coverage action to state court, ruling that the plaintiffs have alleged viable claims under the state insurance code against a nondiverse defendant accused of improperly adjusting the insurance claim.

In a March 24 order, Judge Sam A. Lindsay of the U.S. District Court for the Northern District of Texas found the claims adjuster can be held liable under the Texas Insurance Code and sufficiently alleged that he failed to conduct a proper investigation and improperly adjusted their claim.
